Terms of Sale

General Provisions
These terms are valid exclusively between FRANTOIO BONAMINI S.R.L., hereinafter referred to as the SUPPLIER, and any person making online purchases on this site, hereinafter referred to as the “CUSTOMER”.
These terms may be subject to modifications; the online publication date is equivalent to the effective date.
These general terms govern purchases made in accordance with Directive 2011/83/EU on consumer rights, amending Directives 93/13/EEC and 1999/44/EC and repealing Directives 85/577/EEC and 97/7/EC. (14G00033)

ARTICLE 1 – Subject of the Contract
Under these general terms of sale, the SUPPLIER sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on this site. The contract is concluded exclusively through the internet, by the CUSTOMER accessing the site address and placing a purchase order according to the procedure provided by the site itself.

ARTICLE 2 – Conclusion and Effectiveness of the Contract
1. The sale will be considered concluded upon the SUPPLIER sending the CUSTOMER an order confirmation email. The email contains the CUSTOMER’s details and order information, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent. The CUSTOMER agrees to verify the accuracy of the data contained therein and to promptly communicate any corrections.

2. The SUPPLIER undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies, or minor differences between the site and the actual product may occur. Furthermore, photographs of products presented on the site do not constitute a contractual element, as they are only representative.

ARTICLE 3 – Product Availability
1. Product availability refers to that present at the time the CUSTOMER views the product pages; this should nevertheless be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to others before order confirmation.

2. Even after the SUPPLIER sends the order confirmation email, cases of partial or total unavailability of goods may occur. In this event, the CUSTOMER will be promptly informed and may decide whether to accept delivery of only the available products or request cancellation of the order by communicating via email to customer service.

ARTICLE 4 – Payment Methods
1. Any payment by the CUSTOMER may only be made through one of the payment methods indicated by the SUPPLIER on the site.

2. Communications relating to payment and data communicated by the CUSTOMER at the time payment is made occur on dedicated secure lines and with all guarantees ensured by the use of security protocols provided by payment networks.

ARTICLE 5 – Prices
1. The prices of displayed products may be VAT included/excluded. It is nevertheless indicated on the page whether value-added tax is applied.

2. Shipping costs are not included in the purchase price but are indicated and calculated at the conclusion of the purchase process before payment is made.

3. The CUSTOMER accepts the SUPPLIER’s right to modify its prices at any time; however, goods will be invoiced based on the prices indicated on the site at the time of order and confirmed in the email sent as confirmation of order receipt.

ARTICLE 6 – Right of Withdrawal
1. In accordance with legal provisions in force (Articles 52/59 of Legislative Decree 21/2014), the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 working days from the date of physical possession of the goods, according to the procedures provided in the aforementioned Legislative Decree.

ARTICLE 7 – Delivery Methods and Terms
1. Products will be delivered by express courier to the address indicated by the CUSTOMER at the time of order.

2. For each order placed on the site, the SUPPLIER issues an invoice for the shipped material, following order fulfillment. For invoice issuance, the information provided by the CUSTOMER during the purchase procedure is authoritative. After invoice issuance, it will not be possible to make any modifications to the data indicated therein.

3. The SUPPLIER undertakes to deliver the goods within 30 days from the day following that of order confirmation by the CUSTOMER.

ARTICLE 8 – Liability
1. The SUPPLIER assumes no liability for service disruptions attributable to force majeure or fortuitous events, even when dependent on malfunctions and disruptions of the internet network, in the event it is unable to execute the order within the timeframes provided by the contract.

2. The availability of each item is only indicative, has no contractual character, and no liability may be attributed to the seller in case of unavailability of one or more products.

ARTICLE 9 – Entirety
These General Terms of Sale consist of all the clauses that compose them. If one or more provisions of these General Terms of Sale is considered invalid or declared as such under law, regulation, or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

ARTICLE 10 – Applicable Law and Competent Jurisdiction
These General Terms of Sale are subject to Italian law. Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of the CUSTOMER’s place of residence or domicile, if located within the territory of the State

ARTICLE 11 – Privacy Policy
The Customer is protected by Italian legislation regarding the Privacy Policy (Legislative Decree 196/2003).
